Wisconsin Court Of Appeals District 1 Reaffirmed Lower Courts Decision To Dismissed The Estate Of Luis Lorenzo Wrongful Death Lawsuit Against Defendants El Rey Enterprises LLP/LLC, And Marshall Public Safety LLC

A three judge panel in the Wisconsin Court of Appeals District 1 decided in June 2025 to reaffirmed the lower courts decision to dismiss the Luis Lorenzo wrongful death civil lawsuits against El Rey Enterprises LLP and other parties including Marshall Public Safety LLC.

Milwaukee, Wisconsin - In June 10, 2025, a three penal judge for the Wisconsin Court of Appeals in District 1, Chief Judge Maxine A. White, Presiding Judge M. Joseph Donald and Judge Pedro  Colón ruled that the Estate of Luis Lorenzo by Special Administrator Wanda Rodriguez (Plaintiff-Appellant) in the Luis Lorenzo wrongful death civil lawsuit case filed against (lntervenor-Defendant-Respondent) Kinsale Insurance Company, El Rey Enterprises LLP, El Rey Enterprises II LLC, Marshall Public Safety (MPS), LLC, and Enoch Wilson failed to establish that El Rey or one of their employees were negligent in causing the death of Lorenzo in July 9, 2022 and El Rey Enterprises were not viscariously liable for Lorenzo's injuries and death. The case was dismissed by the Wisconsin Court of Appeals, which also led to the dismissal of the multiple Milwaukee County civil lawsuit cases claiming wrongful death by the Estate of Luis Lorenzo against Marshall Public Safety, LLC and its owner Enoch Wilson.

Wilson, the owner and operator of Marshall Public Safety, LLC is a El Rey's independent cobtractor. The three judge Appeals Court panel agreed "that the Estate's claim for negligent supervision fails on multiple grounds. MPS was El Rey's independent contractor, not its employee, servant or agent within the negligent supervision analysis. Id. at 265. Further, assuming without deciding that employment status was not controlling, the Estate has not shown that El Rey's negligence was the cause-in-fact of Lorenzo's injuries and death. See id. at 262. Therefore, it has not raised a genuine issue of material fact with regard to causation that would preclude summary judgment. Petzel, 320 Wis. 2d 621, ¶5."
