Milwaukee County District Attorney John T. Chisholm has decided not to run for reelection and the Milwaukee County DA's Office seems to practice a 2 justice system in the County, one for Whites and one for people of color, which is justice delayed, according to attorneys representing the Mitchell family.

Milwaukee, Wisconsin - On Monday, the three attorneys, Ben Crump, William Sulton and B'ivory Lamarr representing the Dvontaye L. Mitchell family during a press conference at the Hyatt Regency Hotel say that the Milwaukee County District Attorney's Office is practicing a 2 justice system, one for Whites and one for people of color (Blacks). The White justice system provides quick justice for White victims and the people of color justice system provides justice delayed, which is justice denied for victims. The attorneys wants the Milwaukee County District Attorney's Office under John T. Chisholm, the current District Attorney to practice an equal justice system where both Whites and Blacks victims are equally served justice.
In the homicide case of Dvontaye L. Mitchell, 43, no criminal charges have been filed against four suspects (Hyatt Regency/Aimbridge Hospitality employees), two Whites and 2 Blacks that held Mitchell down after he was brutally beaten with a metal baton on the head by Hyatt security guard Todd A. Erickson, 59, who held Mitchell down with his knee on the neck and another unidentified White worker who placed his knee on Mitchell's back and two arm pressing him down allegedly suffocating Mitchell to death. Another suspect was identified as Herbert Williamson, 52, a Hyatt Regency bellhop who held Mitchell's right arm down.
Attorney Sulton confirmed that there were more than 4 people involved. (1) off duty security, (2) hotel guest, (3) on duty security, (4) front desk manager, (5) bellman, (6) front desk agent, (7) 2nd on duty security, and more.
Attorney Sulton says that the Milwaukee County DA's Office is waiting for Mitchell's toxicology tests from the Milwaukee County Medical Examiner's Office to determine what led to Mitchell's homicide (preliminary ruled as a homicide), but there is enough video footage evidence for probable cause, including the suspects statements to police, in order to charge all those involved with his murder. But the Milwaukee County DA's has not charged the suspects pending the outcome of the Medical Examiner's toxicology test investigation results. Sulton confirmed that the Milwaukee County DA's Office has charged others in non-related cases with criminal charges for probable cause when the investigation is ongoing, but in Mitchell's homicide case, the family has yet to see any criminal charges filed against the murder suspects after 31 days.
Sulton also says, that some of the Hyatt/Aimbridge Hospitality employees were fired, but those in management that gave orders to hold (detained) Mitchell are still employed at the Hyatt. They should all get fired and criminally charged including a hotel guest that was involved in Mitchell's homicide, according to the three attorneys and Mitchell's family.
The Mitchell's family and activists seeking justice for Dvontaye L. Mitchell vowed to continue to seek justice everyday, until all the murder suspects are criminally charged for Mitchell's homicide.
Milwaukee County residents should hold Milwaukee County District Attorney Chisholm and the Assistant DA's accountable for blatantly practicing the 2 justice system in the County, which is definitely discriminatory and unconstitutional towards people of color. Attorney Crump says, if it would have been a Black killing a White victim, the Black individual would have been quickly charged with a homicide. The practice of a 2 justice system in Milwaukee County needs to stop and justice should be served equally.
The Mitchell family also says, that indoor videos leading to the Dvontaye's murder have not been released by the Hyatt Regency Hotel or the DA's Office including the Milwaukee Police Department.
