Rep. Ortiz-Velez claims the WEC failed to make a criminal investigation referral against Luna, who allegedly lied where he actually resided.

Milwaukee, Wisconsin - On Friday, Wisconsin State Assembly Representative Sylvia Ortiz-Velez (D-Milw) released a press release indicating she will seek accountability against Democrat nominee candidate Ismael Luna who allegedly lied where he resided. So far, Luna failed to make his GPS cellphone information public confirming that he actually stayed at 1423 W. Walker Street in the 8th Assembly District.
The Wisconsin Elections Commission (WEC) sent Ortiz-Velez and Luna a letter with their conclusion citing "The Wisconsin Elections Commission does not find reasonable suspicion that Ismael Luna violated Wis. Stat. $$ 12.13(1)(a) and (b), (3)(a), (ag), and (c). Nothing in the complaint proves reasonable suspicion that the address the Respondent listed on his campaign documents and as his voter registration address, 1423 W. Walker Street, is not his residence. The Commission hereby dismisses the complaint pursuant to Wis. Stat. $ 5.05(2m)(c)4.", (no evidence or probable cause) to make a criminal investigation referral against Luna for lying about his actual address, but the ironic situation (you can't make this up folks), the WEC mailed their WEC decision to Luna's primary address at 5786 S. Honey Creek Drive address, which the Luna registered campaign and his Declaration of Candidacy states that his alleged residency address is at 1423 W. Walker Street in the Southside of Milwaukee. The WEC debacle to sent their decision to Luna at the address in question at S. Honey Creek Drive only indicates that the WEC was negligent and failed to do a credible investigation to Rep. Ortiz-Velez's complaint against Luna. Luna's failure to make his GPS cellphone records available to Rep. Ortiz-Velez and the WEC indicates that he can't prove that he actually stayed at the W. Walker Street address. Luna's in a prior response to Rep. Ortiz-Velez's WEC complaint stated, he didn't stay time to time at his W. Rep. Ortiz-Velez says in a press release, that the WEC's decision to decline to issue a criminal referral in the residency and election fraud complaint filed against Luna, ...is not just disappointing—it is a grave disservice to the integrity of our democracy. Although, I recognize the limited authority of the Wisconsin Elections Commission, I anticipate other authorities will continue with their investigations, concerning other issues related to this matter. Our electoral system stands or falls on transparency, accountability, and the unwavering enforcement of our laws. Without them, public trust in the democratic process erodes.
“This formal complaint was backed by compelling, documented evidence—property records and neighborhood testimony—that cast serious doubt on Mr. Luna’s residency claims. The mandate that candidates legally and verifiably reside in the districts they seek to represent is not a bureaucratic detail; it is an essential safeguard of representative democracy.
“By declining to refer this matter for criminal investigation, the WEC sends a dangerous signal that Wisconsin's election and residency laws can be disregarded without consequence. This decision risks opening the door to manipulating statutory requirements and eroding the foundation of fair representation. Election integrity is not negotiable—when rules are bent, the voices of Assembly District 8’s legitimate residents are silenced, and our community’s trust is betrayed.
“Despite my profound disagreement with the Commission’s decision, my resolve to protect the people of Milwaukee and the sanctity of Wisconsin’s elections is stronger than ever. I will relentlessly fight for tougher oversight, unambiguous statutory safeguards, and uncompromising enforcement—because the stakes for our democracy could not be higher.”
