5-year-old Elijo grabbed the loaded handgun from father's bedroom twice while Jaensch, his uncle baby sat him and his 11-year-old sister, according to police.

Milwaukee, Wisconsin - Both Jose Gonzalez, 35, and Bryan Jaensch, 58, are facing 1 felony count each for child neglect causing death with party to a crime for the February 21, 2023 death of Elijo Gonzalez, 5, who died of a self-inflicted gunshot wound to the head.
If convicted, both Gonzalez and Jaensch are facing up to 60 years in prison.
According to police, on February 21, Gonzalez went to work and left his .40 Caliber handgun loaded under his pillow in the bedroom. Elijo went to his father's bedroom while Jaensch, his uncle was sitting on a sofa in the adjacent room while using his cell as Elijo's 11-year-old sister sat next to him.
Elijo while in his father's bedroom, he found the loaded handgun, which he told his uncle that he found a gun. Jaensch went to the bedroom and took the gun away from Elijo and he placed it on the shelf of the bed head board.
Jaensch went back to the sofa, then Elijo's 11-year-old sister told her uncle that Elijo had the gun again. He didn't get up, so the sister yelled at Elijo to put the gun back and then a shot was heard, which Elijo accidentally shot himself in the head.
When police arrived at the scene, they recovered a loaded .40 Cal handgun from the top of a small fridge in the bedroom and a shotgun from under the bed comforter.
Gonzalez told police investigators that he had no gun locks for the weapons and he kept his weapons loaded.
