The criminal complaint says that Johnson, Millner and a third unidentified suspect beat Surprise at a Milwaukee Southside gas station and stole his vehicle.

Milwaukee, Wisconsin - On Friday, both Terry Johnson, 47, and Marvin Millner, 57, were charged with one count each for felony murder, robbery with use of force including a modifier for party to a crime; and Millner was charged with an additional felony count for taking vehicle without the owners consent and use of force for the October 25 beating death of Rodney Jay Surprise, 46.
Both Johnson and Millner are facing up to 15 years in prison for robbery and up to $50,000 in fines each with an additional 15 years in prison each for felony murder. Millner is also facing an additional 15 years in prison for taking a vehicle without the consent of the owner using force.
A cash bond of $75,000 each was set for Johnson and Millner.
Johnson and Millner will have a preliminary court hearing on November 8.
According to the criminal complaint, the three suspects beat Surprise at the Petro Mart gas station at the 2300 block of S. Chase Ave. near W. Lincoln Ave. on October 25. Surprise was dragged out from the gas station by Johnson and a third suspect who punched him while inside the gas station. The suspects also continued to beat him outside near his vehicle.
Millner then got into Surprise's vehicle and drove away leaving Surprise on the pavement.
The incident was recorded by surveillance cameras at the gas station.
Surprise suffered life-threatening injuries and later died at a local hospital from blunt force trauma, according to the Milwaukee County Medical Examiner's Office.
The third unidentified suspect is being sought by police.
